Houston Hurricane Damage Lawyers Recover Denied and Underpaid Insurance Claims

Do you need a Houston hurricane damage lawyer? You may need one if a hurricane damaged your home or business and your insurance company denied, delayed, or underpaid your claim. Our Houston hurricane damage lawyers at Callender Bowlin represent policyholders against insurers that refuse to pay what a covered claim is worth.

You paid your premiums. When a storm hits, you expect your carrier to pay a fair amount, fast. Too often, that is not what happens. Adjusters lowball the roof estimate, blame old damage, or sit on the file until you give up.

You do not have to accept that. Callender Bowlin PLLC is a Houston law firm that focuses on first-party insurance and property damage claims. Founding partners Mark Callender and Josh Bowlin have more than two decades of trial experience in state and federal courts.

No fee unless we recover. We work on contingency, so you pay no legal fees up front. We only get paid if we win money for you. Call (713) 300-8700 or send us a message for a free case review.

Homeowners Insurance Covers Hurricane Wind Damage but Excludes Flood

Does homeowners insurance cover hurricane damage in Texas? In most cases, a standard Texas homeowners policy covers hurricane wind damage, but it does not cover flood. This one line decides most Houston hurricane claims, so it is worth understanding before you file.

Here is the simple version. Wind that rips off shingles, breaks windows, or drives rain into your home through a storm-made opening is usually a covered loss. Rising water and storm surge are different. Flooding is almost always excluded from a homeowners policy and is covered only by separate flood insurance, usually through the National Flood Insurance Program (NFIP).

Insurers use that line against you. After a hurricane, a home can suffer both wind damage (covered) and flood damage (not covered) at the same time. Carriers often try to blame as much as possible on flood so they can pay less. A Houston hurricane damage lawyer can push back and prove how much of your loss the wind caused.

Watch your hurricane or named-storm deductible, too. Many Texas policies apply a special percentage deductible for named storms, which is larger than your normal deductible. Carriers sometimes apply it when they should not. We check that the right deductible is being used.

Insurance Companies Deny, Delay, and Underpay Valid Hurricane Claims

Why did my insurance company deny my hurricane claim? Insurers deny, delay, and underpay valid hurricane claims for reasons that have more to do with their profits than with your policy. Knowing the common tactics helps you spot an unfair result.

Some of the most common carrier tactics include:

  • Blaming your damage on wear and tear or “pre-existing” conditions
  • Calling covered wind damage “flood” so they can deny it
  • Sending a low estimate from an adjuster who works for the insurer
Missing deadlines and dragging out the process
  • Asking for the same paperwork again and again to stall
  • Offering a fast, lowball check before you know what your claim is worth

If any of this sounds familiar, you may have more than a claim dispute. You may have a bad-faith case, which can be worth more than the claim itself under Texas law.

Texas Law Protects Hurricane Policyholders From Bad-Faith Insurers

What laws protect Texas hurricane policyholders? Three parts of the Texas Insurance Code protect hurricane policyholders and give your lawyer real leverage over your insurer. These laws are the reason a demand from an attorney often moves a stuck claim.

Chapter 541Unfair Settlement Practices. This chapter makes it illegal for an insurer to handle your claim in bad faith. That includes misrepresenting your policy, refusing to explain a denial, or failing to try to settle a clear claim fairly.

Chapter 542The Prompt Payment of Claims Act. This law puts your insurer on a clock. In general, the carrier must acknowledge your claim within about 15 days, accept or reject it within 15 business days after it has what it asked for, and pay an accepted claim within 5 business days. If it misses these deadlines on a regular claim, it can owe penalty interest plus your attorney’s fees.

Chapter 542A — Weather Claims. Hurricane damage is a “force of nature” claim, so it falls under Chapter 542A. This chapter has a key rule: before you can sue, you must send the insurer a written notice at least 61 days in advance that describes your claim and the amount owed. Miss that notice and you can lose the right to recover attorney’s fees. That 61-day rule is one big reason to talk to a lawyer early, not after you have already tried to fight the carrier alone.

(Note: penalty interest under 542A follows a statutory formula and is not the flat 18% that applies to non-weather claims. We keep the page accurate on this point rather than overstating it.)

Callender Bowlin Handles Claims From Houston’s Major Hurricanes

Which Houston storms create hurricane insurance claims? Houston’s major hurricanes and tropical storms create thousands of insurance claims every year, and Callender Bowlin handles them. The Gulf Coast location that makes Houston a great place to live also makes it one of the most storm-exposed cities in the country.

Recent and past storms that led to Houston-area claims include:

  • Hurricane Beryl (2024) — widespread wind damage and long power outages across the Houston metro
  • The May 2024 derecho — straight-line winds over 100 mph that shattered downtown windows and tore off roofs
  • Hurricane Harvey (2017) — catastrophic rain and flooding, still one of the costliest U.S. storms
  • Hurricane Ike (2008) — major wind and surge damage across the Houston and Galveston area

Storm damage does not stop at the county line. We help homeowners and business owners across Harris County and the greater Houston region, from inside the 610 Loop to Katy, The Woodlands, Pearland, League City, and the coast.

Hurricane Claims Cover Wind, Water Intrusion, and Extra Living Costs

What does a hurricane insurance claim cover? A covered hurricane claim can pay for wind damage, storm-driven water intrusion, and the extra costs you face while your home is repaired. The exact coverage depends on your policy, so it helps to have a lawyer read it with you.

Common parts of a hurricane claim include:

  • Wind damage — roof, siding, windows, fences, and structural damage from hurricane-force wind
  • Water intrusion from wind — rain that gets in through a wind-made opening, such as a torn roof (this is different from excluded flood)
  • Personal property — furniture, electronics, and belongings damaged in the covered loss
  • Loss of use — hotel, meals, and other living costs if your home is not safe to live in
  • Business interruption — lost income if a covered storm shuts down your business

A carrier will often pay for some of this and quietly leave the rest out. We compare your damage to your policy line by line so nothing covered gets missed. Our Houston property damage lawyers can help you through the process.

A Houston Hurricane Lawyer Strengthens Your Insurance Claim

How does a Houston hurricane lawyer help my claim? A Houston hurricane lawyer strengthens your claim by proving your losses, dealing with the insurer, and using Texas law to force a fair payment. You focus on your family; we handle the fight.

Here is what our team does for you:

  • Reads your policy and finds every coverage that applies
  • Documents your damage with our own inspectors and experts, not the insurer’s
  • Puts a real value on your claim so you are not stuck with a lowball number
  • Handles all contact with the insurance company and its adjusters
  • Sends the required 61-day notice and files suit if the carrier will not pay
  • Pursues penalty interest and attorney’s fees when the insurer breaks the rules

You are far more likely to be underpaid when you face the insurer alone. An adjuster who knows a lawyer is involved, and that the lawyer will go to trial, tends to make a better offer.

Callender Bowlin Represents Hurricane Clients on Contingency

How much does a hurricane damage lawyer cost? At Callender Bowlin, a hurricane damage lawyer costs you nothing up front, because we work on a contingency fee. That means our fee comes out of the money we recover, and there is no fee if we do not win.

This setup keeps our goals lined up with yours. We are paid to maximize your recovery, not to bill you by the hour. It also means you can afford strong legal help right after a storm, when money is already tight.

Your first case review is free. You can talk to an experienced attorney about your claim before you decide anything.

Working with a Local Hurricane Insurance Claims Lawyer

Filing a claim to acquire compensation for hurricane damage is not an easy task as some people would think. There is a whole legal process that, without the relevant knowledge and legal expertise, would be very difficult to navigate successfully.

If you are a resident of Houston and are currently dealing with a hurricane-related insurance claim, hiring a local lawyer could be very beneficial to your case for plenty of reasons:

They will ensure that your rights are being protected

A hurricane insurance claims lawyer has the legal knowledge and expertise. They are well-versed with the law, and as your attorney, they will ensure that you understand your rights and that you are being properly compensated for the damages your property has sustained.

They can review your insurance policies

Insurance policies dictate which losses you are entitled to compensation. By having a hurricane claims lawyer by your side, you will be able to better understand the key details of your insurance policies and possibly, identify more recoverable losses.

They can help gather evidence and prove your losses

Most insurance companies will try to trick you into accepting a lowball offer. With the help of a competent claims lawyer, you will be able to provide your insurers with essential evidence proving your losses as well as their costs.

As a result, you will be able to avoid accepting insufficient compensation for the damages and losses and secure an even better settlement.

Houston Hurricane Damage Lawyers Answer Common Claim Questions

Is hurricane wind damage covered by homeowners insurance in Texas?

Yes. In most cases, a standard Texas homeowners policy covers wind damage from a hurricane. Flood and storm surge are not covered and need separate flood insurance. Wind-driven rain that enters through a storm-made opening is often covered, which is why the wind-versus-flood line matters so much.

How long do I have to file a hurricane claim in Texas?

Report your damage to your insurer as soon as you can, since policies require prompt notice. Legal deadlines to sue can be shorter than you think and depend on your policy and the storm date. Because hurricane claims fall under Chapter 542A, you also must send a 61-day pre-suit notice before filing suit, so talk to a lawyer early.

What is the 61-day notice for a hurricane claim?

It is a written notice you must send your insurer at least 61 days before you file a lawsuit over a weather claim. It has to describe your claim and the amount you say you are owed. If you skip it, you can lose the right to recover your attorney’s fees, so it is best handled by a lawyer.

Can I hire a lawyer if I already filed my own hurricane claim?

Yes. You can bring in a lawyer at any stage, even after the insurer has made an offer or a denial. We can often reopen an underpaid claim and pursue the difference, plus penalties if the carrier broke the rules.

What does it cost to hire Callender Bowlin?

Nothing up front. We work on contingency, so you pay no legal fees unless we recover money for you. The first case review is free.
